Two new instruments in Brazil have widened responsibility for betting advertising beyond licensed operators to the agencies, platforms, influencers and affiliates that create and distribute campaigns.
Interministerial Decree No. 73/2026 took effect on 10 July 2026 and covers betting advertising across all media, formats and channels. SPA/MF Ordinance No. 1.964/2026, which sets the format of risk warnings, followed on 17 July 2026.
The summary below is based on an analysis published by Brazilian law firm TozziniFreire. Businesses should confirm the current position with Brazilian counsel.
What the rules require
Under the ordinance, every betting advertisement must carry a standard risk warning, shown horizontally, clearly and legibly, and taking up at least 10% of the advertisement. The requirement is a proportion rather than a fixed size.
The decree applies to advertising agencies, production companies, digital platforms, influencers, affiliates and anyone else involved in a betting campaign. Before a campaign runs, they must check that the advertiser is an authorised operator on the official list of the Secretariat of Prizes and Betting (SPA), keep the operator’s corporate name, CNPJ and authorisation number, and display that information on the advertisement.
What is banned
- Showing winning bets or the amounts won
- Presenting betting as a sign of personal, social or financial success, including through celebrities
- Urgency devices such as countdown timers and limited-time offers
- Presenting betting as income, investment, an alternative to work or a fix for financial problems
- Advertising on platforms used mainly by minors
- Links or codes pointing to unauthorised operators
Penalties and next steps
Breaches are punishable under Law No. 14.790/2023 by fines of up to 20% of billing, suspension of authorisation for up to 180 days and, for serious repeat breaches, definitive revocation.
For affiliates and agencies, the practical step is to add the SPA list check to campaign approval and to keep records of each operator’s corporate name, CNPJ and authorisation number.
